道德法律化初探

道德法律化,即是将人类的道德、原则、规范铸为法律的过程,同时也是善法由此产生并存在的过程,它在一定程度上直接决定着法律的本质,并为法治的构成建构了基石。道德法律化可提高社会整体文明程度,加强社会制度文明建设,提高社会公民素质,是实现法制化社会的一个前奏曲。我国现行法律在维护社会公德、加强职业道德和婚姻家庭道德方面取得一定成绩,还应从时代需要出发,继续加以完善。

A Tentative Study of Moral Law

Moral law refers to the law of morality and rules of human being, and it is the process which the wise law comes into being. It will decide directly the nature of law to a degree, and lay a solid foundation for the construction of legal institution. Moral law can improve the civilization of the whole society, strengthen the civilized construction of social system and enhance the social civil quality. It is the prelude to the building of the legal system. The present law in our country has made some achievements in defending the public morality, reinforcing professional ethics and marriage family ethics. It should be made perfect according to the demand of the times.
