| 摘 要： | 由我国当代立法体制决定,民办教育法迄今已形成了一个按效力等级纵向分层的法律体系。以不同法律效力等级的民办教育规范性文件的颁布为标志,1978年以来,民办教育的立法工作,大致经历了恢复、开创、探索、成熟等几个发展阶段。《民办教育促进法》的出台,无疑是我国民办教育法制建设的里程碑,与《社会力量办学条例》相比,《民办教育促进法》在一系列问题上均有重大发展。但《民办教育促进法》的法律规范和实施的法制环境还需要进一步健全和完善。

| Abstract: | Decided by contemporary legislation mechanism, a legal system on private education law has been formed through vertical stratification with different effectiveness. Labeled by normalized documents with different effectiveness, private educatin legislation has experienced several stages as restoration, creation, exploration and maturation since 1978. The public appearance of Private Education Promotion Law of PRC must be a milestone during the legislation process. Compared with the former Regulation on Private Schools-running, the new Private Education Promotion Law of PRC has made lots of development on series of key educational issues, but some problems including legal environment still need to be improved and perfected. |
