论我国民事检察权的合理配置

民事检察权作为检察权的一项重要内容,其本身也是属于法律监督权,它包括对法院生效民事裁判检查督促的救济权和就民事公益诉讼提请法院处分的追诉权。我国民事检察权的配置要体现民事检察权性质的要求、体现民事检察权内容和运行机理、遵循正确的配置原则,在上下级检察机关民事检察部门之间和每级检察机关民事检察部门各内设民事检察机构之间,科学、合理地进行。

As an important content of procuratorial power,the civil procuratorial power itself belongs to the legal supervisory power.It includes the power of relieving the clients by inspecting and supervising the effective civil judgements and tracing indictments on the public interests lawsuits by submitting to the court for disposal.To provide and allocate the civil procuratorial power contents,it should embody the requirement of the character of the civil procuratorial power,embody the civil procuratorial power contents and its morement mechanism,adhere to the correct providing and allocating principles and conduct scientifically and reasonably among the civil procuratorial departments of the high and low procuratorial organs,among the internal civil procuratorial branches of each procuratorial organ.
