| 摘 要： | 司法权的本质属性是判断性,并由此衍生出其他属性。因此,司法权的生命在于说理,权威来自于民众对司法裁断公正性的服从与认可。司法权是＂高度个性化的精神推断过程＂,司法权的属性体系为独立性、被动性、中立性等构成的复合体系。

| Abstract: | The essential attribute of judicial powers is judgment,from which other properties are derived.Therefore,the life of judicial powers lies in reasoning;the authority of it comes from the public’s obedience and recognition to/of judicial impartiality.This paper mainly focuses on the assertion that judicial powers are a "highly personalized process of mental inference",with particular elaboration on the nature of judicial judgment and reconstruction of attribute system of judicial powers |
