基于语法隐喻理论的法律文本英汉互译

从语法隐喻视角来分析英汉法律互译,认为语法隐喻在法律语体的建构中起着重要的作用。在法律汉语英译过程中,对隐喻式的选择代表着一种语义选择,经过语法隐喻化后的译文与一致式译文相比有无可比拟的优越性,能更为客观、精确、简洁地传递法律信息,有效实现目的语的概念、人际和语篇功能。在法律英语汉译过程中,译者则需要将隐喻式表达＂拆卸＂为一致表达式以便充分理解原文中语法隐喻的深层意义,使译文不仅准确表达出原文语义而且也符合目的语表达习惯。

English Chinese Legal Translation from the Perspective of Grammatical Metaphor

This paper applies the concept of ＂grammatical metaphor＂ from systemic functional linguistics into legal translation between English and Chinese.It is argued that in the translation of legal language from Chinese into English,the metaphorical mode of expression is preferable to the congruent version because the metaphorical way of expression can help to achieve the desired stylistic effects of legal English such as objectiveness,formal style and conciseness and to realize the ideational,interpersonal and textual meta-functions of the target language.When translating legal English into Chinese,we should understand and unpack the grammatical metaphors in the source language so that the translated text will not only fully express the message in the source language but also appear more acceptable to the intended audience.
