| 摘 要： | 放射性废物安全管理是从废物产生到处置的全过程管理。美国通过《原子能法》《低放射性废物政策法》《核废物政策法》《能源政策法》和《能源重组法》等构成的法律制度体系，理顺了核废物安全管理体制，明确了能源部、环保局和核管会的核废物安全管理职能，使国家的义务和责任、国会和总统的权力职责以及企业的义务和责任等均落到了实处。美国的核废物安全管理立法经验及法律制度对我国具有重要的参考借鉴意义。我国应该制定放射性废物安全管理单行法，完善放射性废物安全管理法律制度体系。

| Abstract: | The safe management of radioactive waste is a kind of whole process management from its generation to its permanent disposal. The U. S. uses such acts as Atomic Energy Act, Nuclear Waste Policy Act, Energy Policy Act and Energy Reorganization Act to assign the relevant responsibilities to the U. S. Department of Energy (DOE), the U. S. Environmental Protection Agency (EPA), and the U. S. Nuclear Regulatory Commission (NRC) respectively. All the acts ensure that the President, the Congress, generators and owners of spent nuclear fuel and high-level radioactive waste can carry out their related duties accordingly. The experience of American legislation is very helpful for China in the field of nuclear waste safety management. China should promulgate the law of radioactive waste safety management and improve the related legal system. |
