关于我国非法证据排除规则适用的若干问题探析

随着《关于办理开刑事案件排除非法证据若干问题的规定》、《刑事诉讼法》修正案的颁布实施,我国虽然构建起了非法证据排除规则的基本框架.但对“刑讯逼供等非法方法”的界定,排除申请的提出时间,排除程序启动的证明标准等问题应作进一步的细化和完善.     

Influence analysis in multivariate linear general models

In this paper we obtain several influence measures for the multivariate linear general model through the approach proposed by Muñoz-Pichardo et al. (1995), which is based on the concept of conditional bias. An interesting charasteristic of this approach is that it does not require any distributional hypothesis. Appling the obtained results to the multivariate regression model, we obtain some measures proposed by other authors. Nevertheless, on the results obtained in this paper, we emphasize two aspects. First, they provide a theoretical foundation for measures proposed by other authors for the mul¬tivariate regression model. Second, they can be applied to any linear model that can be formulated as a particular case of the multivariate linear general model. In particular, we carry out an application to the multivariate analysis of covariance.     

技术、民俗学与现代性的他者

本文以作者在田野经历中对现代记录技术的反思为切入点,考察了民俗学在欧美的兴起与现代化过程,特别是现代科技和机械复制技术的内在联系.一方面,现代机器和技术取代了手工制作与技艺,印刷术普及了书面文字,这使传统生活方式在冲击中成为留恋与怀旧的对象,成为现代性的他者,催生了民俗学学科的诞生;另一方面,现代录音、照相、录像技术克服了视觉和听觉的瞬间性,使稍纵即逝的声音和场景得以固定为可捕捉之物,成为反思的对象,使民俗学研究得以深入展开.     

水与彩的魅力陈述——毛得墚画作印象

毛得墚(德良),1962年生人,辽宁省东港市人,1985年毕业于鲁迅美术学院美术教育系,中国美协会员、辽宁省美协理事、辽河画院专职画家。作品多次获奖,其中水彩画作《倾城乐》获第二届中国美术金彩奖,《瓷盘与干鱼》入选中国水彩百年画展,《苍宇永恒》获首届中国美术创作奖及第十一届全国美展优秀奖。多幅作品被中国美术馆和上海刘海粟美术馆等机构收藏。     

Life Domain Satisfaction: A Portugal–France Comparison

The study was aimed at replicating on a Portuguese sample the seven-factor model of life appraisal (physical autonomy, love life, family life, social life, occupational life, finances, and leisure life) that was suggested by Salvatore and Munoz Sastre Social Indicators Research 53:229–255 (2001). A sample of 1,111 Portuguese participants, aged 17–85, was presented with the Appraisal of Life Questionnaire. The “domain” model of life appraisal satisfactorily accounted for the data gathered on the Portuguese sample. Regarding finances and occupational life, Portuguese scores were lower than French scores. Regarding the occupational score and the leisure score, a clear linear decrease as a function of age was evidenced in the Portuguese sample. Finally, regarding the family score and the financial score, a non-linear relationship with age was found. An increase was observed from young adult age to adult age, and a decrease was observed from adult age to older age. A strong decrease in the physical autonomy scores among Portuguese females was also observed.

15-谜问题的可达性判定

定义了15-谜问题的6个动作规则,在此基础上证明了15-谜问题解的存在性判定的充分必要条件,其充分性的证明过程是一个构造性证明方法,提供了求解15-谜问题的一个解的可实现算法;同时,对此结论进行了扩展,对于给定的一初始格局和任一目标格局,证明了初始格局可达目标格局的的充分必要条件,其结论有助于构造问题的状态空间与限界函数。这两个结论从理论上完全解决了15-谜问题,对获得最优算法提供了理论基础。     

可视性动态模拟在计算机辅助教学中的应用

采用VB、ACCESS和FIREWORKS,开发了一个可视性动态模拟软件。该系统可以演示《数据结构》中《树和二叉树》中树的遍历过程。首先介绍《数据结构》的课程特点及该软件系统目标,然后进行软件设计,最后分析在此设计过程中所涉及到的一些问题及解决方案。
