产权保护为企业创新效率提供了制度基础.相比已有静态性的分析视角,通过《物权法》改革这条主线,在动态性视角下考察产权保护水平对企业创新行为的影响.研究发现,《物权法》实施后,随着产权保护水平的提高,企业的创新活动显著增强,企业的专利数量和质量均显著增加.《物权法》对企业创新行为的促进作用在低市场化进程地区、无政治关联企业以及非国有企业中更为显著.在"法与金融"的研究框架内,从产权保护水平的动态性视角,为企业创新行为提供了合理的解释.物权法的实施进一步发挥了市场在资源优化配置的基础性作用,规范市场经济的民法体系,同时,保护了债权人的利益,促进了外部融资的增长,优化了资源配置效率.研究结论有助于我们正确认识和理解《物权法》实施的政策效果.同时,对于产权保护水平如何影响企业财务行为决策具有重要的政策启示.  相似文献

文章基于政府主导视角,利用2006—2015年我国30个省级面板数据,构建多元回归模型,分析变量之间的关系.其结果显示,环境管制、知识产权保护与区域创新能力之间呈非线性关系,环境管制与知识产权保护同时实施对区域创新能力有显著的促进作用,且具有区域异质性.从企业生存角度出发,提出门槛效应假说,采用Hansen面板门槛回归模型进行检验.结果表明,在环境管制与知识产权保护共同发挥作用时,环境管制必须控制在合理的范围内.最后采用门槛效应回归方法找到了环境管制与知识产权保护对区域创新能力影响的门槛值,并提出相应的政策建议.  相似文献

Child protection and welfare have become international issues in a globalized world. Ideas about childhood and the upbringing of children vary widely, depending upon the prevailing economic, socio-cultural, religious, and political contexts. These have had dramatic effects on the way societies value children, and the role acquired by the state in their protection and advancing their well-being. Children, however, remain at risk. They are placed at risk by the breakdown of extended family systems as a result of urbanization, and as a result of impaired functioning of some nuclear families, in the absence of kinship safety nets. Some traditional cultural practices place children at risk, especially girl children. Poverty creates risks for all children but it can create specific catastrophic risks for girls. Countries can enact visionary laws intended to protect children, but they will be ineffective against entrenched social attitudes, especially if only limited resources can be provided to implement and enforce them. This is the ultimate challenge that the world community must address if the vision of the United Nations Convention on the Rights of the Child is to be realized.  相似文献

People with learning difficulties are considerably more likely to experience sexual and other forms of violence than non-disabled people. Nevertheless, several respondents in this study have demonstrated some self-protective competencies. Most knew of their right not to be violated and a number of participants described situations when they had attempted to initiate their own safeguarding. Some had asked others for help with this. However, appropriate assistance was not always provided. This indicates that risk may be aggravated by social barriers. This paper focuses on highlighting the resistance skills that are prevalent amongst some people with learning difficulties. It concludes with suggestions on ways in which individuals may be further supported to realise their potential to play a more active role in directing and regaining their own protection.  相似文献

Research suggests that age and organizational factors are consistently linked with job stress, burnout, and intent to leave among child protection workers. However, no study has contextualized how age matters with regards to these adverse employee outcomes. We conducted a theory driven path analysis that identifies sources of employment-based social capital, job stress, burnout, and intent to leave among two age groups. We used a statewide purposive sample of 209 respondents from a public child welfare organization in a New England state in the United States. Results suggest that the paths to job stress, burnout and intent to leave differed by age group. Social capital dimensions were more influential in safeguarding against job stress for older workers compared to younger workers. Our results justify creating workplace interventions for younger workers that target areas of the organization where relational support could enhance the quality of social interactions within the organization. Organizations may need to establish intervention efforts aimed at younger workers by creating different structures of support that can assist them to better deal with the pressures and demands of child protection work.  相似文献

This paper presents a qualitative analysis of front‐line practices regarding emergency removals in Finnish and Irish child protection. It examines how the responses to children's immediate danger are framed by legislation and how front‐line practitioners assess the child's situation and make emergency placement decisions. The data consist of interviews with 16 Irish and 33 Finnish social workers. These child welfare protection systems respond differently to a task that appears to be similar. The Irish team‐based practice rests on the social workers' shared assessment of the child's needs, and the formal decision is made by the courts (or police officers at night‐time); and the Finnish practice involves only one single social worker who makes both the assessment and the removal decision. The Irish system is tightly time regulated, whereas the Finnish system provides a more flexible time frame. Both approaches put a lot of stress on social workers' practice, which also includes creative workarounds (e.g., “planned emergency removals” in Finland). Future research will need to explore these features from the point of view of a child's right to protection.  相似文献

The importance of establishing effective inter‐agency working between adult mental health services and child care services in order to safeguard children has been repeatedly identified by research, policy, inquiries and inspection reports. This article reports on the evaluation of an initiative in one health and social care trust in Northern Ireland that aimed to facilitate joint working and so improve service provision and protection for children and families. The Champions Initiative involved identifying a Champion in each multidisciplinary community mental health team and in each family and child care team that would have responsibility for providing information, promoting joint working and identifying any obstacles to better cooperation. The evaluation of this Initiative assessed levels of experience, training, confidence, understanding and awareness in the Champions and their team members at baseline. The Champions and their Team Leaders were then followed up after six months to obtain their qualitative views of the impact of the initiative. The results include comparisons between mental health and child care staff, and crucially, views about whether the initiative has had any impact on working together. This study also generated recommendations for further service development in this complex and important area of practice. Copyright © 2010 John Wiley & Sons, Ltd.

This discussion paper suggests that there is possibly a divergence of opinion taking place within the field of child and family social work and that the stated positions are influencing how practitioners identify and deal with risks and opportunities afforded by the Internet and social media. The suggested divergence is examined and the conclusion drawn is that what is taking place mirrors the fact that the introduction of any new technology inevitably brings with it division and debate. In seeking to understand the reaction to digital technology, consideration is given to a series of wider social discourses on childhood and risk, which includes the controversial notion that the profession is a harbinger of moral panic and that the management of risk has been broadened from child protection to child safety. The discussion paper concludes by calling for child and family social work practitioners to have a balanced debate that needs to be informed not only by current research but also by an open and honest discussion about personal use and an acknowledgement that there will be difficult moral and ethical questions to work through.  相似文献
