从“二程语录”单义词看《汉语大词典》的书证晚出

《汉语大词典》是目前最具权威的一部汉语语词词典，但其书证晚出现象严重，补证这些滞后的书证，对于词语溯源和辞书编撰均有裨益。“二程语录”语词颇具特色，然辞书对其重视不够。本论文以“二程语录”语词为考察对象，共提前《汉语大词典》首引书证滞后的单义词169个。     

多数人侵权视野下的知识产权间接侵权制度

尽管知识产权间接侵权与共同侵权存在关联，但是不能仅将共同侵权作为知识产权间接侵权的参照系，或者试图用共同侵权代替间接侵权，而应当在多数人侵权的视野下考察知识产权间接侵权制度。文章以直接侵权与间接侵权相结合中的教唆侵权和帮助侵权为重点，对共同侵权与间接侵权进行关联性研究；以独立于直接侵权而存在的间接侵权为重点对无意思联络数人侵权与间接侵权进行关联性研究。应当以《专利法》、《著作权法》等知识产权单行法的修订为契机，对知识产权间接侵权进行法定化，总结实践中发生的间接侵权情形，分析现行法中的间接侵权规则的利弊得失，在此基础上建立知识产权间接侵权规则体系。     

The indirect method for stochastic logistic growth models

We developed the indirect method for stochastic logistic growth models involving both birth and death rates in the drift and diffusion coefficients, and not only propose two indirect estimators, but also construct a likelihood ratio-type indirect statistic for testing hypotheses concerning parameters. Simulations show that the proposed two indirect estimators can correct the discretization bias, and the proposed indirect test possesses very good estimated power and size.     

春秋三传中孔子言论辑

专载孔子言论的《论语》大约于孔子辞世后七十余年由其再传后学编成,它无疑是研究孔子思想直接的、可靠的资料。但孔子从三十岁开始收徒教学,从事教育事业近四十年,开设文、行、忠、信各科目,传授御、射、乐、数等六艺,传有弟子三千,学有所成者七十二人。言论之多可想而知,可载于《论语》中孔子言论仅511则,1万6千余字,弟子失记、漏记多有,先秦典籍中就有许多《论语》中未载者。本文从较可信的春秋三传中辑出四十余则,于研究孔子及其思想弥足珍贵。     

Relations between Theory of Mind and Indirect and Physical Aggression in Kindergarten: Evidence of the Moderating Role of Prosocial Behaviors

The present study examined the association between theory of mind and indirect versus physical aggression, as well as the potential moderating role of prosocial behavior in this context. Participants were 399 twins and singletons drawn from two longitudinal studies in Canada. At five years of age, children completed a theory of mind task and a receptive vocabulary task. A year later, teachers evaluated children's indirect and physical aggression and prosocial behavior. Indirect aggression was significantly and positively associated with theory of mind skills, but only in children with average or low levels of prosocial behavior. Physical aggression was negatively associated with prosocial behavior but not with theory of mind. Each analysis included gender, receptive vocabulary, and the respective other subtype of aggression as control variables. These results did not differ between girls and boys or between twins and singletons. Theoretical and clinical implications of these findings are discussed.     

交通肇事逃逸致人死亡的类型化分析与立法建构

交通肇事罪在1997年修订的现行刑法中将其纳入"危害公共安全罪"一章,然而该罪的"逃逸"和"逃逸致人死亡"语义甚为模糊没有具体化,这是一个立法的漏洞,直接导致了司法实践的处理困难和理论的重大争议。通过着重对交通肇事逃逸致人死亡的行为进行建构性的分类,并且对其分类行为分别予以定性,交通肇事逃逸致人死亡的行为都应当定性为故意,一方面是基于对罪刑相适应原则的考虑,另一方面是基于对社会公平正义理念的追求和更为有利地保护公共安全和被害人的利益。只是在对逃逸行为的具体定性上又区分两种情形,在单纯的逃逸中,应当对行为人定交通肇事罪和间接故意杀人;在移动的逃逸中,应当对行为人定交通肇事罪和直接故意杀人。     

Indirect estimation of randomized generalized autoregressive conditional heteroskedastic models

The class of generalized autoregressive conditional heteroskedastic (GARCH) models can be used to describe the volatility with less parameters than autoregressive conditional heteroskedastic (ARCH)-type models, their distributions are heavy-tailed, with time-dependent conditional variance, and are able to model clustering of volatility. Despite all these facts, the way that GARCH models are built imposes limits on the heaviness of the tails of their unconditional distribution. The class of randomized generalized autoregressive conditional heteroskedastic (R-GARCH) models includes the ARCH and GARCH models allowing the use of stable innovations. Estimation methods and empirical analysis of R-GARCH models are the focus of this work. We present the indirect inference method to estimate the R-GARCH models, some simulations and an empirical application.

每个文本都是作为一种源自其他文本的马赛克图案而建构,每个文本都对其他文本加以吸收和转换,所有涉及文化各方面内涵的“前知识”都构成互文性参照.翻译本身也是一个互文的过程.跨文化翻译中的互文指涉,根据其在翻译实践中可保留文化内涵的程度,可采取的翻译策略分为两大类:直接翻译表达和间接翻译表达.     

工程中的间接加载及设计建议

针对工程中均布荷载情况下的间接加载问题，提出计算方法及构造措施，供设计参考。
