论意思自治原则在遗嘱继承中的贯彻

作为民法的一项基本原则,意思自治在遗嘱继承中的作用日益凸现。本文在追溯遗嘱自由原则发展演变的基础上,对意思自治原则在遗嘱继承中的体现做了一个全面的介绍,并就完善我国继承法对遗嘱自由原则的设计提出了自己的见解。     

Kernel Estimation of Rate Function for Recurrent Event Data

Abstract.  Recurrent event data are largely characterized by the rate function but smoothing techniques for estimating the rate function have never been rigorously developed or studied in statistical literature. This paper considers the moment and least squares methods for estimating the rate function from recurrent event data. With an independent censoring assumption on the recurrent event process, we study statistical properties of the proposed estimators and propose bootstrap procedures for the bandwidth selection and for the approximation of confidence intervals in the estimation of the occurrence rate function. It is identified that the moment method without resmoothing via a smaller bandwidth will produce a curve with nicks occurring at the censoring times, whereas there is no such problem with the least squares method. Furthermore, the asymptotic variance of the least squares estimator is shown to be smaller under regularity conditions. However, in the implementation of the bootstrap procedures, the moment method is computationally more efficient than the least squares method because the former approach uses condensed bootstrap data. The performance of the proposed procedures is studied through Monte Carlo simulations and an epidemiological example on intravenous drug users.     

Moderate Deviations for Bayes Posteriors

Let ( X_k ) k be a sequence of i.i.d. random variables taking values in a set , and consider the problem of estimating the law of X₁ in a Bayesian framework. We prove, under mild conditions on the prior, that the sequence of posterior distributions satisfies a moderate deviation principle.

南宋理学极盛的过程与原因试析

宋代理学到南宋孝宗、宁宗时期达到极盛 ,但无论从理学道统承传方面还是从社会政治条件方面看 ,孝宗之前的高宗朝实为理学发展的关键时期。理学由北宋时的民间之学发展到南宋时占主导地位的学派 ,活跃于高宗朝的程门弟子对二程学说的极力推展是一重要因素。同时 ,面对激烈的民族矛盾 ,高宗集团选择了主和派的妥协主张 ,并有意识地寻找与这一政策相适应的学术思想作为其理论根据 ,程系理学正是在这一现实政治需要中得到高宗集团的接纳、支持而逐渐繁荣兴盛起来。到孝宗朝 ,朱熹使理学形成庞大的思想体系 ,标志着中国古典哲学进入了一个新阶段。     

Statistical and Combinatorial Aspects of Comparative Genomics*

Abstract. This document presents a survey of the statistical and combinatorial aspects of four areas of comparative genomics: gene order based measures of evolutionary distances between species, construction of phylogenetic trees, detection of horizontal transfer of genes, and detection of ancient whole genome duplications.     

Assessing goodness-of-fit of categorical regression models based on case-control data

Demonstrated equivalence between a categorical regression model based on case‐control data and an I‐sample semiparametric selection bias model leads to a new goodness‐of‐fit test. The proposed test statistic is an extension of an existing Kolmogorov–Smirnov‐type statistic and is the weighted average of the absolute differences between two estimated distribution functions in each response category. The paper establishes an optimal property for the maximum semiparametric likelihood estimator of the parameters in the I‐sample semiparametric selection bias model. It also presents a bootstrap procedure, some simulation results and an analysis of two real datasets.     

谭献词学理论的继承与创新

谭献是晚清一位词学大家 ,在继承常州派张惠言、周济词学理论的基础上 ,根据自己创作和整理词集的经验和心得 ,提出了新的词学观点 ,进一步完善了常州派词论 ,对中国词学理论有杰出的贡献。谭献的词论主要有 :一、继承常州词派的观点 ,继续推尊词体。二、在词的创作方面 ,提倡比兴柔厚。三、在词的鉴赏批评上 ,提出“作者之用心未必然 ,读者之用心何必不然”的著名观点。

翻译:意识形态的建构、解构、重建与解读

翻译不仅是语言之间信息转换的文化活动,而且是一系列复杂的思维活动。意识形态以不同的语言形式隐藏在语篇之中,以各种隐蔽方式潜移默化地影响着作者写作、译者翻译以及读者解读文本。本文拟以批评语言学为主要方法论,强调翻译中语言分析和社会分析相结合的重要性,同时主张翻译研究应以语篇为单位,特别注意考察作者、译者、读者在翻译过程中的三元关系及其在意识形态的建构、解构、重建和解读过程中的作用,以便弄清翻译的本质并有效地解释那些"不忠"的现象。
