票据抗辩权初探

本文在澄清票据抗辩权和相关概念的含义及区别之基础上,从比较法的角度,分析了票据抗辩权的特征;在对现行票据抗辩事由深入分析的前提下,指出了现行分类存在的缺陷和危害,并对票据抗辩事由进行了新的分类和归纳,以此为基础,还对票据抗辩权的限制进行了具体的讨论。     

Qualified privilege: A defense for the public relations function

Technology continues to challenge the public relations practitioner to find ways to inform key constituents. The new technology has given rise to the “new journalism” that includes a declining traditional media and exploding internet media filled with websites and bloggers. The question posed by this research asks: Does the public relations practitioner inherit the same protection offered by “qualified privilege” that is most often associated with the traditional “press” or “reporter?” The research lays a foundation with an examination of defamation and the defense of qualified privilege. The research concludes that if information gathered by the public relations practitioner meets the “intent” and “content” tests, the information qualifies as news. Passing the “news” test, the defense of “qualified privilege” also attaches to the public relations practitioner.     

注意义务阻却事由之探究

信赖原则与允许危险原则在德国经由判例逐步占据稳固地位,后又传入日本,在西方被广泛适用。信赖原则强调在适当的场合,行为人与他人之间相互存在着可以寄托于对方对于履行必要的注意义务的信赖,过失责任在于未履行信赖所要求的注意义务的一方;允许危险原则注重在适当的场合,允许行为人实施一定限度以内的危险行为,对此行为人无过失责任。与注意义务的赋予不同,信赖原则与允许危险原则通过对于行为人注意义务的否定,进而否定(阻却)行为人的过失责任。在我国科技发展的今天,理论上系统地构建信赖原则、允许危险原则的基本观念,实践中有意识地注重信赖原则、允许危险原则的具体运用,符合刑法的时代要求。

论侵权行为法中受害人的同意

在侵权行为法中,受害人同意是指,受害人就他人特定行为的发生或者他人对自己权益造成的特定损害后果予以同意并表现在外部的意愿。它可以是明示的,也可以是默示的。合法有效的受害人同意包括以下几项要件:必须有明确具体的内容;真实的、自愿的;受害人具有同意能力;加害人尽到充分的告知、说明义务;不得违反法律的强行性、禁止性规定以及公共秩序、善良风俗。合法有效的受害人同意能够作为违法阻却事由或抗辩事由,从而免除加害人的侵权责任。但是,受害人对于犯罪行为的同意既不能免除加害人的刑事责任,也不能免除民事责任。受害人的同意与受害人故意、自甘冒险、免责条款之间既存在相同点,也有不同之处。     

The Systems Psychodynamics of a Joint Venture: Anxiety, Social Defenses, and the Management of Mutual Dependence

Joint ventures, mergers and other forms oforganizational alliances are rapidly becoming a businessnecessity. However, on an almost daily basis, experiencesuggests that such alliances often pose critical dilemmas for those entering into them. Centralamong these are collaborating across differences inorganizational cultures and forging a new organizationalidentity. At a deeper level, there are also often paranoid concerns and fantasies about thelong-term lack of equity in the transfer of knowledgeand capability. This paper, therefore, outlines asystems psychodynamic perspective on intergroup andinterorganizational relationships for developing an in-depthunderstanding of some common irrational and emotionaldifficulties alliance relationships face. It then goeson to describe an illustrative case and concludes with an appraisal of the advantages of a systemspsychodynamic conceptual perspective — taking bothstructure and process into account — which hasbeen neglected or minimized in the literature onorganizational alliances.     

Key Concepts in the Theory and Treatment of Narcissistic Phenomena

In the 90 years since Sigmund Freud opened the dialogue on narcissism, successive theorists have taken turns at defining what it is, where it comes from, whether or not it is healthy, and what to do about it when it is not. This paper summarizes the history of narcissism theory and offers thumbnail sketches of what narcissism looks like from the perspective of several major theorists. From these conceptualizations are derived six key concepts that recur in narcissism theory: (1) differentiation; (2) internal objects; (3) primitive defenses; (4) envy; (5) superego development; and (6) affect regulation. A vignette shows how these phenomena manifest, and strategies for intervention are discussed for each concept.
