论我国法律服务的社会化转型

我国法律服务的实践表明改革法律服务制度和机制势在必行.我国法律服务存在着法律服务行政化色彩浓、质量低等问题.走出这一困境的出路是实现法律服务的社会化,即:法律服务主体的中立化,法律服务形式的多样化,法律服务运作机制的综合化,法律服务价值目标的社群化,法律服务管理的行业化.我国法律服务社会化转型有以下五个向度:从私人行为到公共行为的转变,从临时行为到制度行为的转变,从施舍行为到权利保障行为的转变,从道德化行为到法律化行为的转变,从日常行为到专业行为的转变.

The practice of the law service in our country indicates that it is essential to reform the institution and the mechanism of the law service. In the law service of our country, there are some problems, such as the strong administrant color and the poor quality. The way out from the dilemma is that we must realize the socialization of the law service, and it also means the neutralization of the subject of the law service, the diversified forms of the law service, the synthesized practice system of the law service, the socialized community of the valuable goal of the law service, as well as the administrative specialization of the law service. The socialized transition of the law service in our country has five directions: the transformation from the private behavior to the public behavior, the transformation from the temporary behavior to the system behavior, the transformation from the behavior of giving alms to the behavior of ensuring right, the transformation from the moral behavior to the legal behavior, and the transformation from daily behavior to professional behavior.
