| 摘 要： | 随着互联网的广泛应用,网络自杀现象日益突出,其频繁发生也引起社会各界对与之相关的网络杀人行为的关注。为探析对网络杀人进行刑事规制的理论基础,本文在对其犯罪性质进行分析的基础上,结合我国现有法律规定并参考国外经验,论述了对网络杀人的刑事规制的合理性及可行性,并提出充分利用现有法律资源对其进行规制的建议。

| Abstract: | Nowadays,with the wide use of Internet,cyber suicide is becoming more serious,and its frequent occurrence has urged the whole society to pay great attention to cyber homicide behaviors related to it.Now,the criminal regulation of cyber homicide in our country is still blank.Therefore,based on the analysis of its criminal nature,the author discusses the rationality and feasibility of the criminal regulation of cyber homicide through referring China’s existing legal provisions and foreign experience.Finally,the author puts forward the suggestion that we should make the best use of the existing laws to regulate the cyber homicide. |
