也议沉默权

中国能否移植确立沉默权制度,是刑事法律制度需要回答和解决的问题。笔者认为,在我国刑事法律制度中应当明确规定沉默权,这是与世界法律接轨、实现依法治国的需要,是保证公民合法权利的需要,是防止司法权滥用的需要,是法制文明、社会进步的标志,是司法公正的前提和体现。

Talking About Privilege of Silence

Whether China can be sure about transplanting the privilege of silence or not is an urgent question needed to be answered and dealt with in penal law system.The writer of this paper thinks that the privilege of silence should be regulated in penal law system of our country,for it is necessary to be in line with the world laws and to manage the country,it is also necessary to guarantee people's legal rights;it is effective to avoid the abuse of jurisdiction,and it is a marker of legalized civilization and social progress;it embodies the fairness of the administration justice.
