论政府在慈善活动中的法律定位及制度完善

在慈善活动中，政府的定位应当是慈善事业的适度推动者和慈善活动的有效监督者。从慈善事业的适度推动者出发，我国现行慈善捐赠体制应建立突发公共事件慈善调控平台，弱化政府募捐主体资格，完善政府购买慈善服务制度。从慈善活动的有效监督者出发，政府应联合多部门进行全方位监督，与社会第三方监督机构合作，建立慈善公益诉讼制度。
