| 摘 要： | 儒家孔孟和法家虽然都正视刑罚对治国治民的作用,但两家的"刑罚"观却存在很大分歧。从三个方面分析儒法两家"刑罚"论存在的分歧,并探讨法家韩非子是如何在抨击儒家"刑罚"论的基础上建立法家绝对的"严刑重罚"论。

| Abstract: | Both knowing the importance of penalty in governing a nation and its people, Confucians and Legalists harbor sharply divergent outlooks on penalty. Consisting of three parts, this article analyzes the divergence between the two isms and also discusses how Hanfeizi, the legalist representative, proposed the theory of absolutely cruel penalty on the basis of attacking Confucian penalty theory. |
