我国司法制度转型的意义与问题研究

当前我国司法领域存在的主要问题是司法腐败 ,其根本原因不是司法人员的素质差和具体管理制度的缺陷 ,而是制度性的权力结构存在的缺陷 ,继而导致司法的腐败 ,即我国还没有真正实现在计划经济体制下形成的、以国家权利为本的司法制度 ,向与市场经济相适应的、以公民权利为本的现代司法制度的转型。实现这一转型 ,对“依法治国 ,建设社会主义法治国家”具有重要的意义。这将是一个较长期而艰难的历程。目前在观念上对政治体制改革的目标、方向和核心要明确 ,对司法、司法机关、司法权力等范畴的研究和认识要深化 ,对市场经济与计划经济具有性质不同的法律要求要多加关注 ,对法律承认和平等地维护多元利益主体的新观念要树立 ,并处理好学习外国经验与保持中国特色的关系问题 ,以及扭转“非此即彼”简单类比的思维模式

Studies in Significance and Problem of Transpattern of Judicial System in China

At present,the main problem existing in China's judicial field is the corruption in administration of justice. Its root cause lies not in inferior qualities of administrative personal and defects of particular administrative regulations,but in the defects existing in the institutional power construction which inevitably leads to corruption. This means that China's judicature has not now transpatterned really from the judicature based on state interests which was formed in the system of planned economy to modern judicature regarding citizens' interests as the fundamental which fits in with the needs of the marketing economy. Realization of this transpattern is of great importance toward "administering the country by law and building China into a socialist legal system". This will be a long term and difficult course. What we should do at present is to make clear the objective,orientation,and core of political structural reforms in ideas,to deepen the studies and understanding in the categories of judicature,judicial offices,judicial powers,to show more concern for the different legal demands that the marketing economy and planned economy require in nature,to adopt a new concept of law recognition and equally uphold the pluralistic subjects of interests,and to conduct well the relationships between learning foreign experience and maintain China's characteristics as well as to change the thinking pattern of simple analogy "either this or that".
