刑事司法回应民意机制问题研究

本文分析了当前刑事司法回应民意的缺陷、不足及其原因,并有针对性地指出了刑事司法回应民意机制的建构在于原则与制度的有机结合。民意和刑事司法应该在沟通与协调中获得互相理解和支持,减少社会震动,降低社会成本（包括司法成本、民意成本等）,从而提高司法效率,保证司法公正,提升司法公信力。

Research on Mechanism of the Criminal Justice Response to Public Opinion

This paper analyzes defects,deficiencies and reasons of the current criminal justice response to public opinion,and puts forward a mechanism for the criminal justice response to public construction which is the combination of principles and systems.Public opinion and criminal justice should be obtained in the communication and coordination and support mutual understanding.Thus this mechanism will reduce social unrest and reduce the social costs（including judicial costs,the public costs,etc.）,and improve judicial efficiency,and ensure justice,enhance the credibility of the judiciary.
