| 摘 要： | 商事代理留置权是商事代理人享有的一种特殊权利,具有保全商事代理人债权的功能。商事代理留置权是建立在商事留置权的基础上,以商事代理独立于民事代理制度为前提。它具有民事留置权的一般特征,其形成条件受制于商事代理的营业性特点。商事代理留置权有拒绝返还的抗辩、留置物的处分以及优先清偿的法律效力。

| Abstract: | Business agency lien is a kind of special right enjoyed by business agent,which is stipulated in the laws of Germany,France,Japan and Korea but absent in the law of our country.The article studies the history,concept,formative conditions and effectiveness of business agency lien.It is suggested that business agency lien system should be stipulated in the Warrant Law of our country. |
