| 摘 要： | 司法能力实际上既包括法院整体的司法能力,也包括法官个人的司法能力,但无论要增强哪一种司法能力都离不开法官素质的提高.高超的法律专业知识、丰富的司法和社会生活经验、公正无私的精神、良知和人文素养是法官所应具备的基本素质,应当通过完善我国的法官选任制度、继续教育培训制度和惩戒制度来促进我国法官队伍素质的提高.

| Abstract: | Legal competence includes the overall legal competence of the court and the legal capability of individual judges,both of which require the improvement of judges' quality.A judge is supposed to be qualified with proficient legal knowledge,rich legal and social experience,fairness and disinterestedness,conscience and humanitarian spirit.The legal competence of judges in China should be enhanced through the improvement of the systems of judge appointment,of continuous education and training,and of penalty as well as award. |
