对我国乡村协商民主实践的宪法学解读——基于浙江温岭“民主恳谈”的一种考察

改革开放以来，中国地方的民主实践形式发展迅速，协商与对话的机制被引入各地民主实践之中，成为民主治理的重要内容。特别是20世纪90年代以来，乡村社会已经发展了许多新的协商制度形式，浙江温岭民主恳谈就是我国乡村协商民主发展的典范。运用宪法学原理对浙江温岭的协商民主实践进行分析，可以发现，中国特色社会主义协商政治具有特殊优势，但也存在不少问题。创设理想的协商情境以推动协商民主的深入发展，是今后宪政国家的努力方向。

Scrambling of Constitution Concerning the Practise of Deliberative Democracy in Chinese Countryside——Observation based on the "Democratic Communion" in Wenling, Zhejiang

After the reform and opening-up in China,the forms of practising local democracy had developed rapidly in China.The system of consultation and dialogue has been introduced into the practice of the democracy in various areas and become the important content of democratic management,especially after 1990s,the society in the countryside had developed into many new forms of the consultative system.The democratic communion in Wenling,Zhejiang is the typical example of development of the consultative democracy in the Chinese villages.After analyzing the practice of the consultative democracy in Wenling,Zhejiang by using the principle of the constitution science,we find out that the socialist consultative politics with the Chinese characters is with special advantage,but there exist many problems.To innovate the ideal consultative situation so as to push forward the development of the consultative democracy is the direction the constructional countries should do their best to reach.
