消费风险警示适用的法律限度

摘    要:作为新型政府规制手段,消费风险警示具有成本低、影响广、效果突出等优势,被世界上大多数国家所广泛适用.消费风险警示并非多多益善,其适用也不是没有限制.要对消费风险警示适用范围和适用强度两方面进行限制.除了"禁止适用"消费风险警示的领域,其他情形下是否能发布消费风险警示,则需要具体考量相关因素:与公众利益是否密切相关、目的是否正当、对公众的危害(危急)程度、是否有更好的可替代性措施以及对特定利害关系人权益的影响程度等.消费风险警示适用强度的限制,可以通过对消费风险警示行为的发布时间、发布内容、发布方式和空间范围等要素进行限制,必须坚持比例原则,对诸要素的限制要与行为人违法或危险性质、情节、社会危害程度相当.

The legal limit on the application of consumer risk warnings

Abstract:Consumer risk warning is a new government regulation means,which has the advantages of low cost,wide influence and outstanding effect.It is widely used by most countries in the world.The application of consumer risk warnings is not the more the better and not unlimited.There are two limitations on the application scope and the applicable strength of consumer risk warnings.Whether it can publish consumer risk warnings in other cases,we need to consider particular factors which are closely related to the public interest,legitimate purpose,the degree of harm to the public,and that if there is a better alternative measures,as well as to the specific impact of stakeholder interests.It can be restricted by the publish time,publish content,publish mode and space scope of consumer risk warning behavior.The principles of proportionality must be adhered to.
