| 摘 要： | 我国 1 997年新刑法第八章规定了贪污贿赂罪 ,但贪污贿赂罪不是从来就有的。在我国中华法系发展的整个历史中 ,它的概念和立法经历了一个不断变化的过程。本文考察了贪污贿赂概念的历史由来及其立法的变迁 ,在总结前人打击贪污贿赂行为经验的基础上 ,笔者提出了在社会主义建设新时期更好打击贪污贿赂犯罪的建议

| Abstract: | Chapter 8 of China's 1997 new criminal law provides the crime of corruption(i.e. embezzlement and bribe-taking).But the crime did not exist in the past law system and its concept and legislation have undergone a changing process in the development of China's law system. The article explores the historical origin of the crime and its change of legislation. On the basis of summarizing others' experience of fighting corruption, the author raises a proposal of better fighting corruption in the new era of socialist construction. |
