| 摘 要： | 复制是使用作品的最常见方式,个人使用最突出的问题则体现在私人复制方面。合理使用制度是著作权限制最有代表性的制度,其典型地体现了著作权法保护作者和其他著作权人的利益与促进知识与信息广泛传播的双重目的。私人复制在现有各国著作权立法中少有单独的规定,它一般存于著作权法中合理使用范围之内,但它并非完全等同于合理使用,两者既有区别又有密切联系。研究其关系及私人复制纳入合理使用的条件是有益的,其重点在于把握复制行为目的(非商业性),最终需要纳入合理使用"三步检验法"评判。
