| 摘 要： | 《民法通则》第七条在法学理论与实践中被理解为公序良俗原则或禁止权利滥用原则。在具体适用中,为了防止法官滥用自由裁量权,应当逐渐形成案例类型,建立和完善相应的案例指导制度,以促进法律适用的安定。
