谈环境侵权损害填补责任的社会化问题

从环境侵权特点出发,指出传统侵权救济的缺陷,阐述损害填补责任社会化的必要性,从现代侵权法的发展趋势、利益衡平的需要及公众参与环境决策三个角度分析了损害填补责任社会化的理论根据,阐明了责任社会化的必然性。笔者主张在现有基础上,构建我国的环境损害填补社会化责任体系。

The Problems of Socialization on the Responsibility of the Environmental Tort

In view of the characteristics of environmental tort,this paper indicates the defects of traditional law on relief and compensation and demonstrates the necessity of socialization of responsibility.Then it analyzes the theoretical grounds of socialization of responsibility on relief and compensation in three aspects: the trends of tort law,the requirement of balancing the interests and the participation of the public.In conclusion,the author maintains that it is urgent to construct the social system of responsibility in China.
