| 摘 要： | 运用法律解释学对著作权法进行了解析;认为著作权法内在的缺陷凸显于问题之中,缺陷与问题是矛盾的统一体;并从聚焦问题,分析缺陷,重点对著作权归属、对象和效力的重要条文展开解释,以此提升条文的可适用性;指出著作权法的解释学分析是实用法解释学的重要组成部分,进而为法学界探索著作权法提供了一种新的进路,并试图增强著作权法解决现实问题的能力。

| Abstract: | The copyright law is analyzed by using the law hermeneutics.It is held that the intrinsic drawbacks of the copyright law are highlighted in related problems.Drawbacks and problems form a unity of contradictions.The focal point for analyzing drawbacks is to interpret the important articles of the belonging,object and effect of the copyright law in order to upgrade the applicability of articles.It is pointed out that the hermeneutic analysis of the copyright law is an important constituent part of the applied law hermeneutics,thus providing a new path for the law community to explore the copyright law in an attempt to intensify the ability for the copyright law to solve actual issues. |
