先秦儒家文化与知识产权法律

法律制度的产生有其背后的文化、经济背景 ,作为“舶来品” ,知识产权法律在中华大地上需要与民族文化心理、习惯进行磨合、适应。为此 ,今将视点切入到儒家的发源时代———先秦儒家的思想 ,探寻其对我国知识产权的影响 ,目的是让西方文化上产生的知识产权制度更好地在我国融合、发展 ,同时从民族文化中吸取合理因素 ,指导信息时代面临的知识产权问题 ,建立现代化的具有中国特色的知识产权保护制度。

Confucianism and Intellectual Property Law

The establishment of law depends on culture and economic background. As an exotic, Intellectual Property Law needs acclimatizing itself to ethical cultural minds and customs. The article focuses on inchoate Confucianism by which the author tries to find the influence on Intellectual Property Institution in China. In order to develop the Intellectual Property Institution with China characteristic ,we need to absorb the reasonable element from ethical culture which can instruct us to solute the intellectual property problem brought about by information age.
