试论对行政计划的行政法调控

在现代市场经济条件下,行政计划仍然是国家管理经济与社会事务的重要手段,但行政计划的制定与执行,应遵循依法行政的原则,受到行政法的规范与行政法原理的约束,而不能游离于法治之外。要协调好行政计划与法治主义之间的关系,必须加强对行政计划的行政法调控,重点应明确行政计划的法律依据,完善行政计划的程序,强化对行政计划的法律救济,以实现行政计划的科学化、民主化和法治化的目标。

Regulating and Control of Administrative Plans according to Administrative Law

Under the condition of modern market economy,administrative planning is still an important means to manage economy and social affairs.However,setting up and enforcement should adhere to the principle of administration by law and should be regulated and limited by administrative law.In order to coordinate the relationship between them,it is imperative to strengthen regulating and control of administrative plans according to administrative law by clearing up the legal basis of administrative planning and perfecting its procedure,intensifying legal remedy of administrative plan so as to make it more scientific,democratic and legal.
