| 摘 要： | 司法公信力是社会法治进程中逐步形成的建立在一定社会基础之上的反映国家司法机关与社会公众之间信用、信任关系的社会现象,是社会司法文明的产物。司法公信力生成需要契合社会公平正义的价值取向,需要获得社会公众的普遍心理认同,需要特定的社会政治、经济、文化环境,需要有与之配套的社会制度保障,只有这些基础性条件具备以后,司法公信力才可能逐步孕育并发展成熟。同时,司法公信力在其生成演化过程中也不可缺少理论层面的论证与支持,社会契约论、法治理论是促成司法公信力生成的理论基础。
