| 摘 要： | 民本思想是中国古代政治法律思想中的精华，以孟子为集大成者。但自孟子以后，却屡屡遭到曲解；民本与现代民主的关系，更是难解难分。民本思想对于暴虐政治具有批判的价值，但限于历史的条件，侧重点在于民生问题，对于民权有所忽略。鉴于民本思想本身就蕴含着民主的因子，所以给予适当的铺垫，它就有可能走向现代民主的坦途。这不仅是从理论上讲的，而且中国近现代的政治法律实践也已经作出了证实。
