| 摘 要： | 当今世界,环境问题已经成为人类社会所不得不面对的时代性危机,并构成了环境法形成和发展的自然、社会基础和前提.现代社会法治推行的普遍化,使得法律成为当代社会应对和解决环境问题的基本依据和根本手段.在法治社会条件下,环境法处于应对和解决环境问题的核心地位.同时,面对复杂多样、形态各异的环境问题,环境法往往置身于事实、规范和价值的交汇地带.结合环境法的理论与实践,本文试图对环境法的问题立场、学科导向及其实践指向等根本性的问题进行一些初步的分析和探讨.

| Abstract: | In today＇s world, environmentalproblems have become an urging crisis facing human society, which constitutes the natural and social foundation for the formation and development of environmental law. General implementation of laws in modern society has made legislation the basic means to solve environmental problems in contemporary society. Thus environmental law is at the core in dealing with environmental problems. Meanwhile, faced with complex and diverse patterns of environmental issues, environmental law is often entangled between facts, norms and values. Based on an analysis to the theory and practice, this paper attempts to explore and discuss some fundamental issues of environmental legislation from discipline and practice-oriented perspectives. |
