| 摘 要： | 经济法学界对行为理论的天空一直是比较薄弱的，并已在一定程度上影响了经济法理论与实践的发展。本文基于经济法界有关行为理论的研究现状，提出了专门的“调制行为”概念，探讨了调制行为的地位和构成要件，着重分析了调制行为的重要性和合法性，以及与经济法职能的内在联系、效力等问题，从而揭示其对于解决相关的理论和实践问题的重要价值。

| Abstract: | The studies of the behavior theory are rather weak in academic circle, and it has restricted the development of the theory and practice of economic law. Based on the present behavior theory of the academic circle, this article puts forward the concept of \!regulative behavior\"; discusses the role and the elements of regulative behavior; analyzes its importance, legality, and its connection with the function of economic law; reveals its value in theory and practice. |
