从《大清民律草案》"亲属""继承"两编的界定看我国法律文化的近代转型

<大清民律草案>是我国历史上第一部民法草案,其"亲属"、"继承"两编的规定中既有一定的西方资本主义法律精神,也承继了传统中华法系中以父系家族为本位的宗法思想.作者认为这是缘于三方面原因:一是晚清时期社会结构发生了前所未有的变化.二是西方法律思想已在一部分知识精英和洋务派官僚中深入人心.三是晚清统治者仍是当时世界上最保守的统治集团之一,我国传统的封建礼教思想在社会意识形态中的影响还极为深远.<大清民律草案>中的这种矛盾性真实地反映了我国近代社会的变迁和法律文化的转型状况.

On the Modern Law Culture Transition from the Kinsfolk and Inheritance Rules in Draft Civil Law of Qing Dynasty

Draft Civil Law of Qing Dynasty is the first draft civil law in our country.The kinsfolk and inheritance rules of it not only contained the West capitalistic law minds,but had the traditional Chinese law principles too.Through her research,the author thinks these based on 3 reasons: 1.The social structure of the late Qing Dynasty had changed unprecedented in history.2.The West law ideology had deeply affected a lot of intellectual elite and officials of foreign affairs in the Qing Dynasty.3.The ruler group of the late Qing Dynasty was the one of the most conservative politic groups in the world then,and the Chinese traditional Confucian or feudal ethical codes had great influences in the society.The self-contradictions of Draft Civil Law of Qing Dynasty displayed the history of the modern social change and law culture transition in our country.
