| 摘 要： | 论述在法理学视野中,正义是人们追求的崇高理想,它包括实体正义和程序正义,而程序正义就是实现这一理想的手段和过程.认为理解程序正义必须认识程序、法律程序及其特征;程序正义的内涵与三种分类;程序正义与实体正义的关系,即程序正义决定实体正义、程序正义相当于实体正义、实体正义决定程序正义;程序的正义性标准就在于是否体现其内在价值和外在价值.

| Abstract: | The article elaborates that in the jurisprudence scope,substantive justice is the sublime ideal human beings' pursue.Procedural justice is the very means and process that make it come true.We should know the process of its procedure,the characteristics,procedural justice,its connotation and its three categories.Besides,we should realize that the relation between procedural justice and substantive justice is that procedural justice decides substantive justice,procedural justice equals to procedural justice.What's more,the criterion of procedural justice lies in its internal and external value. |
