| 摘 要： | 中国刑事诉讼法律移植中存在着诸多问题,这是缺乏明确的价值定位造成的。自由和平等作为程序正义的基本要求,符合我国刑事诉讼的价值目标体系,也体现着法治的要求,理应作为刑事诉讼的核心价值目标。

| Abstract: | Due to a lack of clear value proposition design,many problems exist in the process of the law transplantation in China Criminal Procedure Law.As the two basic demands of procedural justice, liberty and equality should be the core value purpose of criminal procedure as they meet the requirements of value goal system of the China's criminal procedure and also reveal the requirements of rule of law. |
