| 摘 要： | 从唐律中德法关系的几方面特点来看,唐律虽然也强调＂孝亲＂,但终以＂公法＂优先于＂私德＂,以＂忠君＂优先于＂孝亲＂;唐律中＂刑罚＂的目的着眼于外在行为的调控,而不是道德＂教化＂;唐律强调为子、为臣要＂顺上＂,强调对＂人＂的服从,而不是＂从道＂、＂从义＂。唐律的所有这些特点都是一种＂改造＂了的法家思想。

| Abstract: | This paper aims at exploring the legalist thought in Tang Lu according to the relation between morality and law.Although the "virtue of filial piety" was emphasized,"communal law" took precedence over the "private morality," and "royalism" over the "virtue of filial piety" in Tang Lu.The purpose of "punishment" in Tang Lu was to regulate the behavior instead of moral civilizing.Tang Lu put emphasis on sons or ministers’ obedience to the superior instead of morality and justice.All these characters of Tang Lu indicated a kind of "altered" legalist thought. |
