中国司法制度改革的若干问题

本文分三个部分,对中国司法制度改革的历史背景、中国司法制度改革的具体内容、中国司法制度改革存在的问题及中国司法制度改革的发展趋势作了介绍和讨论.中国司法制度的改革是为了适应社会的要求,司法制度改革主要是对司法组织的人事制度和民事审判制度进行,司法制度改革中存在的主要问题是观念滞后、改革缺少统一的规划以及改革未完全依法进行.司法制度改革的发展趋势是司法独立进一步加强,法官资格更为严格、法官素质进一步提高,司法制度改革朝全面性展开,与司法制度改革相关的一些制度会伴随着司法制度改革而进行相应的变革和发展.

Some Problems of the Reform of China's Judicial Systems

The paper consists of three parts: the historical background of China's judicia l system reform; an introduction and discussion of the problems in China's judic ial reform and the drift of China's judicial system reform. In China's present s ituation, the personnel system in judicial organizations and civil judicial syst em should be reformed. The chief problems in the reform of judicial system are t he obsolete ideas and the lacking of unified planning in judicial reform. The ma jor matters of the reform of judicial system are: the strengthening of judicial independence, the improvement of the quality of judges,etc. Other reforms associ ated with the reform of judicial system will come into being.
