| 摘 要： | 合理性是现代社会的一项重要原则,也是我们判断一切事物的基本依据。作为国家刑罚权的运用策略,刑罚政策的合理性既包括实质合理性(价值合理性),也包括形式合理性。刑罚政策的实质合理性主要体现为刑罚观念的转变与刑罚制度的改革;其形式合理性则表现在刑罚政策过程即刑罚政策制定、执行及评估的科学性。

| Abstract: | The rationality is an important principle of the modern society,as well as the fundamental basis for us to judge all affairs.As the applied tactics for the state punishing right,the rationality of the punishing policy includes both the substantial rationality(value rationality) and the form rationality.The substantial rationality mainly embodies the change of punishing idea and the reform of the punishing system.The form rationality is showed in the punishing policy course,i.e.the scientificness to make,carry out and evaluate the punishing policy. |
