| 摘 要： | 中国古代优秀的法律文化曾经在相当长的时期内影响了周边国家和地区的法制进程,对世界法制文明作出了突出贡献。即使在今天,西方许多思想家在对本国法律文化反思时,也常常不忘从中国传统法律文化中汲取营养。法治社会应对情、理、法重新认识,挖掘其合理因素,正确看待情、理、法结合在实现法律体系本土化、保障司法公正以及增强判决执行力中的价值,并在立法和司法实践中合理运用情、理、法。

| Abstract: | Excellent legal culture in ancient China had a long period of time affecting countries and regions around the legal process and legal system of the world made outstanding contributions to civilization.Even today,many Western thinkers reflect on their own legal culture,they often forget to traditional Chinese legal culture to absorb nutrients.We should love the rule of law,reason and law to re-understand,and tap its reasonable factors,combined with a correct view of Reason Law legal system to achieve localization,protection of justice and enhance the value judgments in the execution,and legislative and judicial practice in the rational use of reason,law. |
