| 摘 要： | 大学自治是现代高等教育管理学中的一项基本原则，但大学自治不是绝对的，司法审查介入大学自治是必要的，可对其进行保障与监督；同时，这种司法审查又是有限的，仅限于制约侵害权利和程序的现象，而不涉及实质性的教学和学术问题。本文通过翻译美国历史上两个典型案例，说明了二者之间的关系。

| Abstract: | Self government of university is a basic principle in the management of modern high education,but it is not absolute,and it is necessary that judicial review should intervene it,guarantee it and supervise it.And at the same time,this kind of judicial review is limited to restraining the invasion of rights and process,instead of involving the substantive problems in teaching and academic research. |
