论我国刑法的引导性文化品格之塑造

所谓刑法的引导性文化品格，是指刑法应有的对人的行为起引导作用的文化特性。它使刑法具有引导性、文化性、人文性和自主性等特征。从人本法律观出发，为了弘扬刑法的人文精神、实践刑事法治和彰显刑法的人权保障机能，在我国必须塑造刑法的引导性文化品格。在没有宗教赋予法律以神圣性，且过分强调宗教与法律分离的我国社会，只能依靠具体的法律实践来塑造刑法的引导性文化品格。在刑事立法层面，在追求对先进制度移植的同时，应当力求对传统优良刑法文化进行吸纳，并应突出个人法益在刑法法益体系中的地位；在刑事司法层面，通过司法改革，确立司法权的独立地位和公开状态；在法制宣传层面，从广度和深度上都应当有所推进。

On Molding the Guidable Cultural Character of Chinese Criminal Law

The guided cultural character of criminal law refers to its cultural peculiarity to guide human behavior.It makes criminal law guidable,cultural,humanistic,and autonomous.In our country,which overemphasizes the separation between religion and law and in which the holiness of law is not granted by religion,the guidable cultural character of criminal law must be modeled so that it can develop humanistic spirit,realize criminal rule-of-law,and guarantee human right.The modeling should rely on the concrete practice of law.In the criminal legislation level,we should adsorb the excellent culture in traditional criminal law and make individual legal interests prominent in the legal interests system while transplanting the advanced system;in the criminal judicature level,we should confirm the independent and open position of judicature by reform;and in addition,we should make legality more publicized.
