| 摘 要： | 沉默权副作用是构建我国沉默权制度的最主要障碍,只有很好地消除人们的此种心理恐慌才有可能真正建立起沉默权制度。我国应当采用综合治理的方式建立沉默权消解机制:构建有限沉默权制度,从沉默权内部限制其副作用;构造配套措施,从外部消解沉默权副作用;加强社会治理,构建预防、理解和接受沉默权副作用的人文环境。

| Abstract: | The side effects of the right of silence are the main hindrance against building the system of the right of silence in China.Only by effectively eliminating psychological terror can the system of the right of silence be built.Thus,China must take comprehensive measures to build it up: to set up a limited system of the right of silence to control the side effects of the right of silence from the inside,to perfect matching measures to eliminate the side effect of the right of silence from the outside,and to strengthen social management to establish the cultural environment for preventing,appreciating and accepting the side effect of the right of silence. |
