论法治型政府的构建

法治型政府成为十年政府改革的目标之后,亟待从理论上对法治政府的内涵、目标体系及实践路径加以解读。其中,法治、政府、法治国家、法治社会、依法行政、法治行政等范畴的厘清成为体认法治型政府内涵的理论前设。以此为基础,政府职能、权限、行为与主体的法治化共同支撑起法治型政府的目标体系。在目标指引之下,坚持价值整合与制度创新、主体自律与他律监督、内部自发与外部促动的结合路径,法治型政府的构建才具有达致的可能。
