| 摘 要： | 通过考察英美法系专家证人制度中有关专家证人的资格和选任、专家证人的功能和性质、对专家证言的可采性规定、专家证人的出庭和法律责任,以及考察并比较大陆法系鉴定人制度中有关鉴定人的资格和选任、鉴定人的功能和性质、对鉴定结论的可采性规定、以及鉴定人出庭接受法庭询问、鉴定人的法律责任等问题,提出了在鉴定人出庭、鉴定结论的可采性规定及加强鉴定人责任等方面对我国的启示。

| Abstract: | The paper mainly introduces the regulations on the qualifications and selection of expert witness, the functions and characters of expert witness, the acceptability of the expert testimony, the appearance in court as expert witness and his/her legal responsibility in the legal system of Britain and America. Then, the author compares the legal system of Britain and America with that of China in above aspects. Finally the author points out the great enlightenments of the legal system of Britain and America on our country's legislation in the aspects of the appearance in court as expert witness, the acceptability of expert conclusions and in strengthening the responsibility of expert witness. |
