从西汉法律看中国传统道德的法律化

道德的法律化是中华法系一个重要特征,其实质是通过儒者的活动把儒家的伦理道德转变为法官审判的依据或法律条文。从零星记载的汉律条文中可以窥见:在汉代,这一现象已经渗透到立法、司法中。立法方面表现为对"孝"、"尊老爱幼"及家庭伦理等基本原则的维护;司法方面,表现为"春秋决狱"。此后,在汉律影响下,传统道德继续其法律化进程,至《唐律疏议》的出现,则标志着这一过程的终结。

Analyzing the Legalization of the Chinese Traditional Morality through the Law of West Han Dynasty

The legation of traditional morality is the special phenomenon of Chinese genealogy of law.Its nature is an article by the fact that activity of Confucian person changes ethics of the Confucian School morality into the basis or law that the judge tries.Passing the initial study to the law of West Han Dynasty,we may discover that ethics value,the morality of "respecting the aged and loving the young" and family ethics value have been in the lawmaking of the period of West Han Dynasty.In the aspect of judiciary,there is the phenomenon of adjudication in accordance with the book of Chunqiu.Henceforth,in the effect of law of Han Dynasty, the legation of traditional morality has been going on.When the book Explanatory Notes on the law of the Tang Dynasty came out,it is thought to be the end of the legation of traditional morality.
