| 摘 要： | 从法律的角度看,对婚姻的本质有诸多认识,也形成了各种学说,如:契约说、身份关系说、婚姻伦理说、制度说等.本文以"自由、平等、公平"的契约理念符合婚姻法的精神为依据支持婚姻契约说,并进一步以契约理念对2001年修正的婚姻法进行再认识,指出其回归契约之处及存在的不足.

| Abstract: | From the legal point of view, there are many cognitive understandings of the essence of marriage leading to various doctrines,such as the contract theory, identity theory, marriage ethics theory, institution theory and so on. This article sustains the contract theory on the basis of the contract idea of " freedom, equality, and fairness" in accordance with the gist of the marriage law. To further understand the marriage law amended in 2001 in the concept of contract,it points out that the amendment partly regresses to the contract idea and its existing shortcomings. |
