| 摘 要： | 在经济犯罪领域,单位与自然人共同实施犯罪行为,基于自然人的身份的不同,可以分为单位与单位外自然人和单位与其内部成员两种.对于前者成立共同犯罪没有什么问题,而对于后者不能一概而论,应具体情况具体分析.在能够成立共同犯罪的情况下,鉴于刑法对于单位和自然人犯罪的数额标准规定不一致,适用何种标准对于单位和自然人的定罪量刑至关重要.而对于单位内部成员来说,虽然其所具有的双重身份是共同犯罪成立的前提条件,但是不能成为对其进行并罚的理由.
