| 摘 要： | 网络的技术特性使得原有的著作权保护制度难以有效地在这一领域发挥作用 ,针对网络作品的侵权行为愈演愈烈即是一大例证。而如何对网络作品进行定位 ,在网络环境中对于著作权行使的限制以及著作权侵权行为归责原则等问题的修正已成为促进网络健康发展、完善著作权保护体制所急需考虑的问题
