| 摘 要： | 罚款作为欧共体委员会制裁卡特尔行为的一项重要行政处罚手段,经过多年的实践,尤其在2004年欧共体竞争法现代化过程中,得到了迅速的发展,并形成了比较完善的体系。现行的罚款政策进一步提高了罚款标准的清晰度和透明度,更加明确了实施罚款的条件和程序,增强了罚款政策的确定性和可预期性,从而加大了对违法行为的威慑力。另外,一些减免罚款的新手段和工具的适用,也使罚款的制裁效果进一步加强。

| Abstract: | As an important penalty used by EC Commission in Cartel cases, Fining policy is developed quickly in past years and established its own operation system especially during the modernization of EC Competition Law in 2004. The present fine policy system further increases the clearness and transparence of the specific criteria of fine, clarifies the conditions and procedure, strengthens the determinacy and anticipation of fine policy thereby boosting its deterrent effect. Coupled with some other methods for immunity or a reduced fine, fine policy constitute the most efficient weapon in the Commission's armory to fight Cartels. |
